NIHT Infosolution Private Limited ("we," "us," or "the Company") acts as a Data Fiduciary under the Digital Personal Data Protection Act, 2023. We are committed to protecting the privacy and security of the personal data of our users ("Data Principals"). This policy outlines our practices regarding the collection, storage, and processing of your digital personal data.

2. CONSENT AND THE DATA PRINCIPAL

By engaging with our services or website, you provide your free, specific, informed, and unconditional consent to the processing of your personal data for the purposes described herein. You have the right to withdraw this consent at any time as easily as it was given.

3. CATEGORIES OF DATA COLLECTED

We collect only the minimum necessary information to provide our services:

  • Identity & Contact Information: Name, email address, phone number, and mailing address.
  • Google Ads API Data: For the purpose of account management, we retrieve performance data (clicks, impressions, conversions), keyword data, and audience insights from your linked Google Ads accounts.
  • Technical Data: IP address, browser type, and usage patterns collected via cookies for website optimization.
4. PURPOSE OF PROCESSING

We process your data for the following specific purposes:

  • Service Fulfillment: To manage lead generation campaigns and provide digital marketing services.
  • Google Ads Optimization: To analyze campaign performance, identify negative keywords, and scale successful ad sets using AI-driven internal tools.
  • Communication: To send periodic emails regarding your account status, service updates, or responses to inquiries.
  • Compliance: To fulfill legal obligations under Indian law.
5. DATA STORAGE AND RETENTION

In accordance with the principle of storage limitation under the DPDP Act:

  • Form Data & Emails: We retain basic contact and form submission data for a period of 365 days to maintain business continuity and historical records.
  • Google Ads Performance Data: Performance data retrieved via API is stored for 60 days for trend analysis and is thereafter securely erased.
  • Secure Deletion: Upon the expiry of the retention period or the withdrawal of consent, we ensure that your personal data is permanently deleted from our servers and any third-party processors.
6. RIGHTS OF THE DATA PRINCIPAL

Under the DPDP Act, you are entitled to the following rights:

  • Right to Access: You may request a summary of the personal data being processed and the identities of any data processors involved.
  • Right to Correction & Erasure: You may request the correction of inaccurate data or the completion of incomplete data.
  • Right to Nominate: You may nominate any other individual to exercise your rights in the event of your death or incapacity.
  • Right of Grievance Redressal: You have the right to readily available means of grievance redressal provided by the Company.
7. DATA PROTECTION & SECURITY

We implement robust technical and organizational measures to prevent data breaches. We use SSL encryption for data in transit and secure, restricted-access servers for data at rest. While we take every precaution, no system is 100% secure; in the event of a data breach, we will notify the Data Protection Board of India and affected individuals as required by law.

8. GOOGLE ADS API COMPLIANCE

We explicitly state that:

  • Our tools retrieve data from the Google Ads API (including performance and keyword data).
  • This data is used solely for managing, reporting on, and optimizing ad campaigns for our clients.
  • We do not share API-retrieved data with third parties or use it for any purpose other than those authorized by the account owner.
9. GRIEVANCE REDRESSAL

In compliance with the DPDP Act 2023, we have appointed a Grievance Officer to address any concerns regarding your personal data.
